XML Spec (rev 3):

2.8 Prolog and Document Type Declaration

[Definition: XML documents SHOULD begin with an XML Declaration 
which specifies the version of XML being used.] For example, the 
following is a complete XML document, well-formed but not valid:

<?xml version="1.0"?>
<greeting>Hello, world!</greeting> 
----------------------------------------------------------------

It's not compulsory, but IMHO it's very bad practice to omit it.

A DTD is NOT an XML Document. The XML Spec permits a Text
Declaration in a DTD (the External Subset, production [30]),
but IMHO this should be avoided in cases where it might
mislead software into trying to parse the file as an XML 
Document, which it is not.

(Personally I believe production [30] was a poor choice, 
but it's part of the Spec so we have to live with it. There
are lots of things in XML which many people disagreed with...:-)
