A DTD is NOT an XML Document. The XML Spec permits a Text Declaration in a DTD (the External Subset, production [30]), but IMHO this should be avoided in cases where it might mislead software into trying to parse the file as an XML Document, which it is not. (Personally I believe production [30] was a poor choice, but it's part of the Spec so we have to live with it.
