No, the 1991 Gulf War was authorized by specific security council resolution.

No, because American history goes back further in history than the date on which congress ratified the UN 
charter by an overwhelming majority vote.

It has nothing to do with "declarations of war", it is to do with complying with the UN charter, which the US 
has signed up to, and ratified, and is therefore bound by.
