Peter,

There was a grand jury if I'm not mistaken, which decided that enough 
evidence existed to warrant charges and a trial.   Just before trial, 
the judge and lawyers decided that the law was too vague to justify 
going through an expensive trial merely to have it ruled a "vague" law.

I'm not a lawyer, so the particulars I cannot explain.
