It was created from the disassembly of the original TTD executable.
This means that it may not have been legal to put it under the GPL
license.

We've had this discussion already on TT-Forums, in fact, it was long
ago. There are some people who refuse to play OTTD because it may have
been created illegally, but the majority either don't know about it or
don't care about it. My personal opinion is that the current copyright
owner of TTD is unlikely to do anything about this (especially that no
one seems to be sure who exactly owns the copyright), so it is safe
not to care about this. (*)
