CAN SPAM, the worst, weakest spam law in the world, defines it as commercial mail where the recipient hasn't told them to stop, along with commercial mail that has fraudulent characteristics. As weak as it is, most of the spam you get violates CAN SPAM and the reasons there's no action against the spammers has nothing to do with the definition of spam. The new Canadian law and all of the European laws define it as unsolicited commercial mail, with various sized loopholes for B2B mail or mail to people you already know somehow.
