Clearly it is a good thing to pay attention to issues raised in a document like 3238. On the other hand, we should keep in mind that it is a "consideration" document from the IAB, rather than something that has been given force of IETF law. Even better is that it was created as input to a working group that is still underway and that has not yet produced any standards. Blanket enforcement of 3238, at this stage, would be an odd kind of prior restraint.
