There's a possibility that the OS itself might allow for modification date
earlier than creation date (for instance, imagine a file that you've
extracted from an archive - its creation date would be when you extracted
it, but its modification date would be the date stored in the archive), so I
don't think that mandating that the creation and mod date should be changed
is a good idea.

Obviously, an error code is appropriate in cases where the command couldn't
possibly succeed - for instance, if the date requested does not exist in the
OS (say, before 1970 on Unix).

No - changes to the attributes of a file are not the same as changes to the
file itself.
