I do not believe Alice's request message needs to have a special indication 
in it with "what to do" here.

Let me give two scenarios:

Alice dials 1-1-2, meaning she is calling for help. Her UA recognizes this 
and chooses to use TLS, knowing proxies cannot easily (or at all) decrypt 
S/MIME.

Alice sends her location in an IM to Bob. She is not calling for emergency 
help.  Her UA S/MIME encrypts the message body.  If Bob then tells her he 
received her IM but not the associated location, Alice can do something 
special to her UA to (one time only probably) send her location in an IM to 
Bob without S/MIME.  This will probably be using SIPS (i.e. TLS).

Does this make sense?
