I think that the answer must be yes.

The basic syntax is just that, syntax.  Presence semantics is quite 
different from IM semantics.  I view MIME as labeling semantic 
objects.  There is some flexibility about when to use a new MIME 
content-ype, versus when to use an attribute label associated with a 
content-type.  However I believe that a common syntax between IM and 
Presence objects is not enough to argue for their having a common Mime type.
