I seem to recall that Philips, one of the founders of the CD standard and 
it's main "protector" have made noises in the past that they would consider 
suing distributors claiming that something is a CD when it violates the Red 
Book protocol and not allowing them to claim it's a CD, under both consumer 
"description of goods" and "trademark violation". CD is, after all, a 
trademark of Philips and (I think) JVC.
