I'm ignorant of the EU's requirements. Is the government required by the
EU to do this?

Article 11 of the Universal Declaration of Human Rights opposes
retroactive increasing of the penalties of "penal offences." Would it be
wise to compare opposition to retroactive copyright extension with article
11?
