Monitor mode in intel 4965

Dear all,
I am using kernel 2.6.31:
Linux n-0471 2.6.31-19-generic #56-Ubuntu SMP Thu Jan 28 01:26:53 UTC 2010 i686 GNU/Linux
And my wireless drivers are:
03:00.0 Network controller: Intel Corporation PRO/Wireless 4965 AG or AGN [Kedron] Network Connection (rev 61)
The problem I have is that I get an error when I try to set the wireless card in monitor mode:
$sudo iwconfig wlan0 mode monitor
Error for wireless request "Set Mode" (8B06) :
SET failed on device wlan0 ; Device or resource busy.
I am not sure which wireless drivers I am using, the (I think) relevant modules that appear doing an lsmodpci are:
iwlagn 109052 0
iwlcore 112796 1 iwlagn
mac80211 181140 2 iwlagn,iwlcore
led_class 4096 2 iwlcore,thinkpad_acpi
cfg80211 93052 3 iwlagn,iwlcore,mac80211
Reading the documentation from the mac8011 project it seems that monitor mode is not supported for this driver. If that is the case, are there any other drivers that support it? How could I use those instead of mac80211?
