No reason to be more "pure" about this than the major manufacturers with FCC 
/ CE certification (e.g. Motorola, Proxim, Trango, Tranzio, Ubiquiti, etc ). 
Besides any liability lies with the manufacturer / installer, certainly not 
Ath5k / Madwifi developers.
