rtl8139 and wol

I'm having problems with successfully resuming wol
functionallity on my rtl8139 after a a successfull
linux boot to runlevel 3 (with networking enabled).
I fave tracked the problem only to occour if the
interface gets configured with an IP ADDRESS.
If I boot to runlevel 1 and only load the NIC modules
the problem does not occour (although if previously
the machine booted normally this does not restore
normal wol operation).
The only way to restore correct wol operation is with
the dos setup software.

Anyone have any ideas on how to solve or work around
the problem ?
