That's disappointing, but not at all surprising.

No technical reason, it's entirely political.
Few people ask this question on the kernel mailing list, and none of the
kernel maintainers believe that there is a problem.

Jeff Garzik at Mandrake is the one that restructured the tulip driver,
and got the modified versions of the many drivers in place of the
originals.  Thus you are unlikely to convince Mandrake to change.

To be clear, the distributions include a modified version of the tulip
driver.
