default ACLs disappearing when used with CVS?

I have a curious problem with CVS. I can shut down CVS access and set ACLs on all directories and files in the repository, then copy the ACLs to the default ACL for all directories. Next, start up CVS and allow writing. It works fine for a while, but then I start getting directories that have no default ACLs of any kind and files therein without any either. This seems to inconsistently appear; often showing up first in the lockdir. All access occurs through pserver. How can the files and directories start appearing without any extra ACL information than the old POSIX model?
