I'd goto nomem here. Also two nits: struct page_counter *counter is never read; and the function relies on the caller's css reference to keep tc valid across reclaim_tier()/mem_cgroup_oom() (the RCU lock only covers the list walk) - worth a comment before someone adds a new caller.
