MeEinhG defines time by referencing "koordinierte Weltzeit" (UTC), which includes leap seconds. However, - this kind of "official time" is only required "im amtlichen und geschäftlichen Verkehr" (where sub-minute precision is rarely required). - UTC is written as calendar date and clock time, not as seconds since epoch. Therefore I think your conclusion that counting leap seconds is required by law is wrong.
