There's nothing stopping you doing that - patching and building a kernel is 
something that is (or with a little effort, could be) within your grasp if 
you wished to do it.

I will try to retrieve a URL for this which provides some info about building 
your own kernel - it's really not that intimidating.

What you say about 2.6 is pretty much correct, with a small note:  You can 
install a 2.6 kernel if you installed into the 'unused space' on a 10GB drive 
(sometimes referred to as F:) as this can be formatted to 'linux native', 
thus allowing you to play games still.

There's pretty much no chance we would incorporate a patch like this one into 
the xbox-linux kernel patch itself, as it's not an xbox linux issue, 
therefore doesn't belong in the xbox-specific patch.  You might well be able 
to persuade the distro makers to incorporate it themselves (Shallax for 
GentooX, and gimli aka Ed Hucek for Xebian) though.  

If you can get the official Linux maintainers for the 2.4 series to 
incorporate a patch, so much the better, because that is where it belongs.
