I'm aware of such possible problem, the card has "Powered by ATI" logo, 
and this means (acording to ATI):

I'm a system engineer, I have no knowledge of Gigabyte implementation of 
ATI specifications, ATI says about "Powered by ATI" boards that " An ATI 
Partner Product is a graphics board that is based on an ATI chipset but 
manufactured by a company other than ATI. These other manufacturers, 
sometimes referred to as Original Design Manufacturers (ODM’s) or Add-in 
Board (AIB) manufacturers, buy ATI graphics chips and design their own 
board product around it."
I see no reason why ATI would let other manufacturers use an ATI logo 
while they wash their hair with ATI specifications. But if this is the 
case, ATI will never see money from me again, neither their "valued 
partners".
