I think Neale wants to keep this driver separate from the kernel to better maintain it. There is some benefit from including drivers/kernel source code into the upstream kernel as then more people review it, look at it and start improving it. I haven't looked at it recently, but it still requires to define a device major in case no devfs is used or otherwise a dynamic device allocation on the user side. (If the driver is in the kernel source proper, I'd expect it to have a device allocated etc) I think cpint is a nice package and is well accepted by the mainframe community.
