The quick answer is: RHEL4's up2date does not work with new-style yum
repositories, although some code is there in an attempt to make it work.
I tried to fix this, but did not succeed in a reasonable timeframe, so
for X/OS Linux (our RHEL4 rebuild) I use old-style yum repositories for
up2date, created witgh yum-arch. I made some fixes too, and an
extension to fix the zero-package-size problem.

See http://download.xoslinux.org/pub/xoslinux/4/i386/updates/SRPMS/up2date-4.4.69-25.XOS.2.src.rpm for the patches I made (note that the tarball is
X/OS-Linux specific, but the generic patches are included separately
in the src.rpm).
