I have observed the same problem in Ubuntu 12.10 which uses the ToI
patch in git branch tuxonice-3.5. No problems with previous Ubuntu
versions (kernel 3.2.0 or lower). Since you also observe this, it
looks like that the problem is in ToI and not in Ubuntu?
