Hi Federico, I'm currently using ToI with a kernel 3.7 and it has been rock solid. I have heard of some users having problems with 3.8... but I haven't tried that myself. Maybe it has something to do with your hardware? Do you use pm-utils? This package has a history of causing hibernation problems, at least to me. It is supposed to fix all kinds of power management problems, but has a lot of corner cases for legacy hardware which end up ruining hibernation and suspend for newer computers. If you do use pm-utils, try installing the hibernate script (also a sub-project of ToI). It takes some time to set up properly and a bit of nosing with the config files, but it gets the job done beautifully, especially when compared to pm-utils. A quick way to find out if pm-utils is messing with your system is to try hibernation via the command line. As root, do "echo /sys/power/state". Wait for it to hibernate, and then resume. If it works without a problem, then it's something to do with pm-utils or your configuration.
