Precisely, 

I was. I said We cannot use legislation to prohibit specific vendors
from bidding/competing for work with the government. 
(legal exclusion defined)

Tom said that we can and do and then started describing something else
entirely.  - bid requirements, procurement regulations and the like.
But of course even these cannot prohibit a specific vendor from
competing for a job.  They merely raise hurdles for ALL vendors
to jump over.  

Those that can't, won't get the work.

And Yes -I admit that those "hurdles" can be specifically crafted to
favor specific vendors.  This form of favoritism will always be with us.
