Possible problem with $posts_last_24hours

I have the following posts from an individual which occurred at

2007-09-13 21:27
2007-09-13 21:28
2007-09-14 06:24

I have access_rules as follows:

unset=dup_checksum, unset=dup_partial_checksum
ALL

post
consult, reason="User has exceeded the max number of posts withinn 24hr 
period"
$posts_last_24hours > 2

post
deny, replyfile=UnsubFoundInText
$admin_unsub >= 50

post
consult, reason="Address was not found in the subscriber list"
!@MAIN

post
consult, reason="Address is in the supervised list."
@badguys

The problem was that the last post at 06:24 did not trigger the consult. 
Can someone explain why?
