I disagree.
1) If you act as the employee/agent/contractor for the recipient then
you are not 'transfering'. So as long as somewhere in my terms and
conditions I inform the buyer that I am acting on their behalf when I
install and patch qmail, then I am not transfering.
2) Anyway, transfering is not banned by djb's conditions. Distribution
is. And since he doesn't define distribution then it's undefined until a
court decides what he means by it. Maybe they would take the dictionary
definition, maybe they would take the industry definition, maybe they
would make up their own based on a synthesis of these. Either way, until
a court or djb rules that moving a machine with his binary on it is
'distribution', then it isn't.
