As RMS says, "Intellectual property" is not a legally significant
concept.  Copyright, trademarks, and patents are legally significant
concepts; they might be called "intellectual property" collectively,
but they don't really have all that much in common, so grouping them
together that way usually serves only to confuse.  What you say about
active protection is true of trademarks, but I don't know that it's
true of copyright.
