RE: Use of "googling" on zoe.nu

Dear Sirs:

The email you received was not spam.  We use Cyveillance's service to send
emails on our behalf.  The text of the email we sent is as follows:

It has come to our attention that you are using the phrase "Googling your
email" on your site, http://www.zoe.nu, to mean "searching your email."  Our
brand is very important to us, and as I'm sure you'll understand, we want to
make sure that when people use "Google," they are referring to the services
our company provides and not to searching in general.  I attach a copy of a
short, informative piece regarding the proper use of "Google" for your
reference.  

 

We are concerned that your use of the phrase "Googling your email" is likely
to cause confusion, as consumers may be led to believe that you are using
Google's services.  This use also is likely to harm the value of Google's
trademark by using it in a generic sense.  Therefore, we must ask that you
immediately cease use of this phrase or any other phrase that incorporates
"Google."

I would like to bring to your attention the dubious activity of the mailer
agent "JMail 4.2.0 Free Version by Dimac", apparently operated by
"cyveillance.com" from IP address "65.57.245.11", relayed through IP address
"63.100.163.122".

This mailer agent is sending, on your behalf, a badly formatted, unsolicited
email (also known as SPAM) containing a large, unidentified, binary
attachment (potentially a virus).

This activity has all the trademarks of unsolicited commercial email
(UCE) -or worse- and brings disrespect to your company brand.

Please investigate this matter at your earliest convenience.
