I think his lawyer were grasping at straws and trying anything to get what they realize is the inevitable delayed. It is understandable for lawyer in capital case appeals to have such irony lost on them. And I mean that sincerely - I am not opposed to the death penalty in principle but those guys/girls invest their heart and souls into those cases. It is rather noble I think.
