I would suspect that it is not the killing in that scenario that is what is being (or worthy of being) honored in the first scenario...it is the selfless courage and risk of the situation.  If killing was the criteria, everyone who shot someone in combat would get one. (And I realize you were not suggesting they WERE...but Fischer clearly does not understand that)
