Sure there is equivelence. One of the arguments for treating waterboard as "not torture" after centuries of it being considered torture (please note, up until the Bush aministration it was considered torture-and America has put people to death for it) was that we would be putting all those torturers in "harm's way" (they could be sued or go to jail) for simply "doing their job."
