I'm not an expert but I believe that is part of the War Powers Act, which is 
"extra-constitutional".  There is an argument as to when the War Powers Act 
clock starts ticking and/or when it technically applies to a military action.    


I'm disgusted by Obama's Orwellian hypocrisy on this issue, and watching what I 
did of his speech would have had me rolling on the floor laughing at the double 
speak/standard if it weren't such a serious thing.  Also waiting 10 days after 
committing troops to speak to the public and explain it, (to the extent that 
farce could be called an explanation), is beyond an abject failure of basic 
leadership.  The whole things seems to be ill thought out and half-assed.  
But....

I think that the conservatives going after him on the constitutional issue would 
be first in line claiming that a republican president had the power to do what 
Obama is doing.  Obviously, the law/constitution can be argued both ways, just 
as it can be and is on many other issues, but I don't believe the issue has 
never been definitively decided by the Supreme Court.  


Personally, I think a case can be made that stopping genocide or massive 
atrocities is legitimately within our national interest.  I'm not sure Libya 
reaches that level, though.  Suffice it to say there was far more legitimate, 
non wmd, justification for taking out Saddam than there is for what we are doing 
in Libya.
