Subject: [DADL-OT] Farewell to the 4th amendment

To depressing to elaborate upon. The only consolation is that the Kentucky
upreme Court could rule that the mere sound of movement behind the closed door
f a home does not create exigent circumstances. If they had done that in the
irst place this case might not have been granted certiorari. As it is now, if
he police mistakenly show up at your door and hear you moving about inside
fter they knock and announce themselves, they are entitled to presume that you
re destroying evidence and break down the door and search your home.

f interested note the language with which Alito talks about contact with the
olice - it is so unbelievably out of touch with the experience of the people
he 4th Amendment is designed to protect. It would be laughable, but for the
eriousness of the erosion of the 4th Amendment.
