For the record, I would to.  

The key factor is whether the police properly identified themselves and if
he *should* have known they were not burglars or not.  

It is tragic and also is open to the question to the legitimacy of the raid
itself.   Until they stop suppressing stuff this is just an argument without
meaning.

Speaking for myself, in an area where home invasions were prevalent, if
somebody broke into my house, I'd consider brandishing a weapon and, with
appropriate warning, shoot the motherfucker three times center-mass. I trust
that is specific enough for you. That may not be very Christian, but there
it is. (Furthermore, so would have Mal Reynolds, but that's another
thread.)  ;)
