Whether it is free speech or invasion of privacy is the question isn't it? Without her name on the billboard or other definitive means of identifying her it leans toward the former because he could easily say I wasn't talking about her but "another" girlfriend. But it is still classless and that defense would just add being a liar to him being a jerk. Free speech does cover being a jerk, generally speaking.
