That's pretty much how I see it. That said, he will lose simply because of the abortion aspect. Without her name on the billboard or other definitive means of identifying her it leans toward the former because he could easily say I wasn't talking about her but "another" girlfriend. But it is still classless and that defense would just add being a liar to him being a jerk. Free speech does cover being a jerk, generally speaking.
