Rather late to the discussion, but gmane has screwed up so it looks new again :)
Also I just saw this interesting comment on groklaw (huge URL multi-lined for
gmane's unforgiving filter) :

i.e, surely copyright infringement "on a commercial scale" also covers the
flagrant knowing infringement of GPL'd code by the likes of CherryOS
(http://www.ht-technology.com/cherryos-pearpc/cherryos-pearpc.html), various
Mplayer ripoffs (http://slashdot.org/article.pl?sid=04/01/03/146209&tid=), the
many BusyBox infringers (http://www.busybox.net/shame.html) and so on.

It's still a bad, poorly thought through directive that should be opposed (in
the unlikely event we get any say), but it would be an amusing side effect if it
caused scum like this to be raided, convicted as common criminals and sent to
prison ...
