openssl fail?

i compiled with this options:
./configure --with-openssl=/usr/local/ssl/ --enable-embedded-perl
--enable-shared --without-root-access
make
but when i run make test i get 4 fails:

Summary: 40 / 44 succeeded.

so later i cannot use ssl encryption!, i previously installed OpenSSL
0.9.7from the sources
this is Debian 2.6.12-9-686

can somebody help me??
