I'm pretty sure your example is *not* valid CQL; I believe the ANY 
keyword is mandatory.
   SELECT * FROM CIM_InstModification
   WHERE SourceInstance ISA CIM_ConcreteJob
   AND ANY SourceInstance.CIM_ConcreteJob::OperationalStatus[*]  = 17
   AND ANY SourceInstance.CIM_ConcreteJob::OperationalStatus[*] = 2

My understanding is that Pegasus' CQL filter does accept your version - 
but SMI-S requires the version with ANY.
