Ok, so now we're getting a clearer picture on what you want to accomplish.
It seems you're interested in publishing some material and desire to control
it and the framework it uses.  The concern being that your framework; ie the
schema/namespace/schema, are such that you have concerns about it being
'hijacked' by others and being robbed of potential compensation for your
efforts.  Does that summarize the situation?

The thought that occurs to me is that you're going to have to ask anyone you
expect to utilize your schema to license it from you and to abide by the
terms of said license.  A software license contract lawyer could doubtless
fill you in on the appropriate details.  And likewise if you limit the
delivery of the content in some controlled fashion (http auth
username/password, etc) then you presumably have some legal authority there
as well.  Provided, of course, that you have the parties involved in the
process sufficient bound by contractual obligations.  If, however, you're
publishing the data "for free" or without some specifically controlled steps
then it would seem like you wouldn't have much control over the consumer's u
se of it.  But I'm not a lawyer and wouldn't presume to hazard mere guesses
here.

So, setup your schema, namespace and publish data using it.  Establish
sufficient contracts with the various participants and move ahead.  I
suspect the latter will present challenges.  Then you're faced with the age
old problem of convincing the market to compensate you for your labors.
Having or not having a copyright/trademark/patent on something won't do a
damn thing to make you money if you don't put aggressive efforts into
advancing your cause.

Is this basically the gist of the issues?
