Looks good, I tested out 2.6.3 + tux patch on my system.

I have preempt enabled, and even "sysctl -w net.ipv4.tcp_low_latency=1" 
for good measure.

After giving tux a good workout with apachebench, I don't see any kernel 
warnings at all.
