Recap of House Bill 641 - Revised Concealed Handgun Carry

I've recapped the provisions of the new law below and added comments. 
The new law will go into effect in June. I would expect that NM DPS 
will issue final rules addressing questions such as "grandfathering" 
of existing licensees.

1) Extends the life of a license to 4 years from 2 years.

2) Lowers the minimum age of licensees to 21 years from 25 years

3) A refresher course is required every 2 years. 

[MRG Comment – this is a requirement even though licenses will be 
good for 4 years.]

4) Licenses will include the category and largest caliber of handgun 
the licensee is licensed to carry, with a statement on the license 
that the licensee is allowed to carry smaller caliber handguns. 

[MRG Comment – presumably, carrying a smaller caliber handgun has
to be within the same category as noted on the license. In other 
words, if you are licensed for a .44 magnum revolver, I assume you 
will not be able to carry a 9mm semi-automatic. Perhaps this will be 
cleared up in the final rules.]

5) Only one concealed handgun may be carried at any one time.

6) Licensee is required to file a police report with a local law 
enforcement agency if a license is lost or stolen.

7) The renewal fee increased to $75 from $50.

8) NM DPS will develop rules necessary to implement reciprocity of 
concealed handgun licenses issued by other states. Reciprocity will 
be recognized if; a) the other state's license has an expiration 
date; b) the other state can verify a license within 3 days; c) the 
other state has disqualification, suspension, and revocation 
standards; d) the other state requires applicants to submit to a 
criminal history check; e) the other state requires the applicant to 
not be prohibited from possessing firearms pursuant to federal or 
state law; and f) requires the applicant to complete a firearm safety 
program to include deadly force, weapons care, maintenance, safe 
handling, storage and marksmanship.

[MRG Comment – item "f" above may preclude reciprocity
with some states – I believe there are some that have no firearm 
safety course or program requirement.]

9) Section 7. A new section of the Concealed Handgun Carry Act is 
enacted to read:
"CURRENT AND RETIRED LAW ENFORCEMENT OFFICERS.--

A. An application fee, a renewal fee and a firearms training course 
are not required for an applicant or licensee who is a certified law 
enforcement officer pursuant to the Law Enforcement Training Act.

B. A retired law enforcement officer is not required to submit an 
application fee or a renewal fee if:

(1) the officer was a certified law enforcement officer pursuant to 
the Law Enforcement Training Act for at least fifteen years prior to 
retirement; and

(2) the retirement is in good standing as shown by a letter from the 
agency from which the officer retired.

C. A retired law enforcement officer who has been retired ten years 
or less is not required to complete a firearms training course.

D. A retired law enforcement officer who has been retired for more 
than ten years shall be required to complete a firearms training 
course. The officer shall be allowed to attend any local law 
enforcement agency's firearms qualification course; provided that the 
officer supplies the officer's own ammunition, handgun, targets and 
range equipment. A local law enforcement agency shall not be liable 
under the Tort Claims Act for providing a firearms training course to 
a retired law enforcement officer pursuant to this subsection.

E. A retired law enforcement officer's concealed handgun license 
shall have printed on the license "retired police officer" and shall 
be valid for a period of five years."
