Geneva, Standing committee on copyright and related rights.

This morning, after a few NGOs interventions regarding
limitations and exceptions, the committee started to talk about
what they really care about:  the webcasters' treaty.  7 hours or
so about it.  Phase 1, discussion of the scope of the treaty and
how it will include webcasters.  Nigeria had a great image to
summarize the "alternative paper" proposed by the chair which
include 3 options the opt in, opt out or protocol.  For Nigeria,
these are 3 doors that lead to the same room.  The same
delegation did a great job explaining that including
"simulcasting" (the EU's proposal) is the same as including
webcasting, since if you accept simulcasting in...webcasting will
follow.

Developing countries took the floor to express their opposition
to webcasting again and again but the chair kept it on the table
no matter how much opposition was expressed. I understand that
there was a lot of noise and many delegations complained and even
ask to hear some NGOs but the Chair did not allow NGOs to take
the floor.

Phase 2 of the meeting focused on the substantive rights and was
just as negative.  Delegations after delegations opposed
extensive rights, TPMs, longer terms.  Some brought up the UNESCO
work on cultural diversity and the need to limit broadcasters
rights.  It was noted again that article 6, rights of
retransmission on computer network is also a back door way to
include webcasting.

The meeting ended "in the middle of a sentence"... and will
resume tomorrow at 10am.

PS some delegates have been complaining that right holders groups
have been lobbying in their capital to prevent them from doing
their job in Geneva.  It's getting nasty.
