Dear all,

after talking with the author of PHPAuction.org, it seems this is not
a GPL violation at all, but a violation of proprietary software.


Background:

There is the old PHPAuction.org version available under the GPL, the
two newer versions are only available as proprietary software. Once
all customers of the proprietary software have switched to the newest
version, Gianluca Baldo (the author) intends to release the second
latest version as Free Software under the GPL then.


Situation:

What that company seems to have done is to sell a modified version of
that proprietary software, so there is no GPL violation involved and
our interest in the case ends here.

I have told Gianluca Baldo that we would be willing to discuss
possible ways of making PHPAuction.org entirely Free Software,
however.=20
