Such rights must not disappear only because electronic indexing is possible much faster than doing it with pen and paper. I also think that the author of the index has the rights to keep it to yourself, or distribute it with whatever license and policy he likes (under the terms and with the limits I already mentioned above and in previous posts) In any case the right to index and parse is not the right to redistribute or sell the original documents against the license it came with.
