Hard Disk Error

On my new laptop, when i booted I got this error:

EXT3 fs error: Journalling Error
and then it mounts the disk as readonly. And I can log in to the X
only sometimes. And it scans hard disk every time i boot up saying
that there are errors. It takes more than five minutes to scan my
whole root partition - 30 GB

There is a tool in the bios which is like "Hard disk self test". When
i do it, sometimes I pass, sometimes I fail.

After I boot, if i do fsck. I get lots of errors.

My laptop is brand new, is this a serious error? How can i rectify it?
I can change the hard disk as it is under warranty.

 It was working fine, one fine day (yesterday- not all that fine day)
this error occured. I dont remember doing anything particular for the
error to occur.

It took me more than a day to make my laptop the way it is now!! All
my cool features and stuffs. Can i copy all the files to my new hard
disk and still get my old OS or do I have to copy only the home folder
and then install a new OS and then do all the rest of the work?
