I think the clue to my problem(s) is in your dmesg.

I do not have a dvb device created at boot. Instead I have a vbi0 created 
in /dev/v4l/

cx88[0]/0: registered device video0 [v4l2]
cx88[0]/0: registered device vbi0

Looking at the hardware list created by xawtv this is clear

rick@rick:~/dvb_setup/linuxtv-dvb-apps-1.1.0/util/scan$ xawtv -hwls
This is xawtv 4.0-pre, running on Linux/i686 (2.6.12-rc4)

probing dvb devices ...

probing vbi devices ...
 [vbi] /dev/vbi0             DVICO FusionHDTV DVB-T Plus      PCI:0000:00:09.0

probing video devices ...
 [v4l2] /dev/video0          DVICO FusionHDTV DVB-T Plus      PCI:0000:00:09.0
 [v4l] /dev/video0           DVICO FusionHDTV DVB-T Plus
Xlib:  extension "XVideo" missing on display ":0.0".

The dev/vbi0 and video0 are symlinksto devices in /dev/v4l

So there seems to be something I missed along the way any maybe  I need to go 
over my kernel .config and/or maybe I'll have to backtrack to a 2.6.11 kernel 
with patch. I know that there is a guy in SA whose gotten freevo up and 
running in slack-10.1 with a dvico fusion dvb-t on a patched 2.6.11 kernel
