Fink is not going to like to use items outside of the ones it manages to be able to satisfy version dependency.  In this case it probably isn’t an issue, but making special cases on vague criteria can lead to instabilities and make fink unmaintainable.

You are probably better off installing the fink TeXLive and using that or if you must, make /Library/Tex/texbin a symbolic link to /opt/sw/bin
