RFC 959:

         LIST (LIST)

            This command causes a list to be sent from the server to the
            passive DTP.  [...]
                        [...].  The data transfer is over the data
            connection in type ASCII or type EBCDIC.  (The user must

            ensure that the TYPE is appropriately ASCII or EBCDIC).

So, there may be a client-side bug involved (if the client ignores the
parenthetical note) or a server-side bug (if not).  I'd have to snoop
the protocol to be certain.
